These are the Terms of Service governing the use of this Service and the agreement between You and the Company. These Terms of Service set out the rights and obligations of all users regarding the use of the Service.
Your access to and use of the Service is conditioned on Your acceptance of and compliance with these Terms of Service. These Terms of Service apply to all visitors, users and others who access or use the Service.
By accessing or using the Service You agree to be bound by these Terms of Service. If You disagree with any part of these Terms of Service then You may not access the Service.
You represent that you are over the age of 18. The Company does not permit those under 18 to use the Service.
Your access to and use of the Service is also subject to Our Privacy Policy, which describes how We collect, use, and disclose personal information. Please read Our Privacy Policy carefully before using Our Service.
Purchasing Services and Digital Products
By placing an Order for Goods through the Service, You warrant that You are legally capable of entering into binding contracts.
Your Information
If You wish to place an Order for Goods available on the Service, You may be asked to supply certain information relevant to Your Order including, without limitation, Your name, Your email, Your phone number, Your credit card number, the expiration date of Your credit card, and Your billing address.
You represent and warrant that: (i) You have the legal right to use any credit or debit card(s) or other payment method(s) in connection with any Order; and that (ii) the information You supply to Us is true, correct and complete.
By submitting such information, You grant Us the right to provide the information to payment processing third parties for purposes of facilitating the completion of Your Order.
Order Cancellation by the Company
We reserve the right to refuse or cancel Your Order at any time for certain reasons including but not limited to:
- Goods availability or scheduling constraints
- Errors in the description or prices for Goods
- Errors in Your Order
We reserve the right to refuse or cancel Your Order if fraud or an unauthorized or illegal transaction is suspected.
Your Order Cancellation Rights
All sales of coaching services, workshops, memberships, and digital products are strictly final. Because access to our digital materials, vaults, and booking calendars is granted immediately upon purchase, You do not have a right to cancel Your Order or request a monetary refund once the transaction is complete.
Any Goods You purchase can only be managed in accordance with these Terms of Service and Our Return & Refund Policy. Our Return & Refund Policy forms a part of these Terms of Service.
You will not have any right to cancel an Order for the supply of any of the following Goods:
- All services, coaching packages, and live workshops, for which all sales are strictly final.
- The supply of Goods made to Your specifications or clearly personalized.
- The supply of digital products, downloadable audio files (including guided breathwork or somatic tracks), PDFs, or pre-recorded video vaults once access has been granted or the file downloaded.
- Coaching sessions, online classes, or live group breathwork workshops that have already been delivered, or sessions canceled with less than 24 hours' notice.
Availability, Errors and Inaccuracies
We are constantly updating our live workshops, digital products, online classes, and coaching packages on the Service. Because our offerings are highly tailored and dependent on private enrollment caps or dynamic booking calendars, certain items, digital links, vault materials, or session slots may occasionally be described inaccurately, mispriced, or temporarily unavailable. We may also experience occasional technical delays in updating scheduling openings or service descriptions across our portal and in our digital announcements.
We cannot and do not guarantee the absolute accuracy, completeness, or real-time precision of any information displayed on the Service, including specific session availability, live workshop pricing, masterclass descriptions, or curriculum specifications. The Company reserves the right to modify, change, update, or correct any pricing entries, description errors, inaccuracies, or scheduling omissions at any time without prior notice.
Payments
All Goods purchased are subject to a one-time payment unless a continuous Subscription plan or multi-month payment installment plan is expressly selected at checkout. All payments made through the Website are securely processed through our integrated third-party payment processor, Stripe. We accept major credit and debit cards authorized by Stripe, including Visa, MasterCard, Discover, and American Express.
Payment cards are subject to validation checks and authorization by Your card issuer. If We do not receive the required authorization from Stripe or your financial institution, We will not be liable for any delay, suspension, or non-delivery of digital access to your coaching portal, vaults, or scheduling calendars.
Subscriptions
Subscription period
The Service or some parts of the Service are available only with a paid Subscription (such as continuous coaching retainers, monthly somatic/breathwork groups, or recurring membership spaces). You will be billed in advance on a recurring and periodic basis (typically monthly or annually), depending on the type of Subscription plan you select when purchasing.
At the end of each period, Your Subscription will automatically renew under the exact same conditions unless You cancel it or the Company cancels it.
Subscription cancellations
You may cancel Your Subscription renewal at any time either through Your private Account settings page inside your portal or by contacting the Company directly via email at misha@misharank.com. All recurring payments are strictly non-refundable. Upon cancellation, you will not receive a refund, prorated credit, or reimbursement for the fees You already paid for Your current billing cycle. However, You will retain complete access to the designated member areas of the Service until the end of Your current paid Subscription period, at which point your portal access will automatically terminate.
Billing and Payment Failures
You shall provide the Company with accurate and complete billing information including full name, billing address, zip code, telephone number, and a valid payment method authorized through Stripe.
Should automatic billing fail to occur on your scheduled renewal date for any reason, the Company will attempt to re-charge the payment method on file via Stripe and issue an electronic notice. You must update your billing information or proceed manually with full payment within a designated deadline date. The Company reserves the right to suspend Your Account, vault access, and live coaching scheduling links immediately if any automated subscription payment cycle fails or is declined.
Fee Changes
The Company, in its sole discretion and at any time, may modify the Subscription fees. Any Subscription fee change will become effective at the end of the then-current Subscription period.
The Company will provide You with reasonable prior notice of any change in Subscription fees to give You an opportunity to manage or terminate Your Subscription before such change becomes effective.
Your continued use of the Service after the Subscription fee change comes into effect constitutes Your agreement to pay the modified Subscription fee amount.
Refunds
Except when strictly required by applicable law, all paid Subscription fees, membership dues, and recurring service installments are completely non-refundable.
Promotions
Any Promotions (such as early-bird discounts, holiday coupons, or special program launches) made available through the Service may be governed by rules that are separate from these Terms of Service.
If You participate in any Promotions, please review the applicable rules as well as Our Privacy Policy. If the specific rules for a Promotion conflict with these Terms, the Promotion rules will completely override this Agreement for the active duration of that specific promotion.

Social Login and Linked Accounts
If the Service allows You to sign in, connect, or otherwise interact with a Third-Party Social Media Service (such as logging into AttractWell using your Facebook or Google credentials), You authorize the Company to access and use information made available by that Third-Party Social Media Service in accordance with Our Privacy Policy and Your active privacy settings with that Third-Party Social Media Service.
The Company does not control and is not responsible for the technical availability, uptime, accuracy, or content of any Third-Party Social Media Service, and Your independent relationship with that Third-Party Social Media Service is governed strictly by its own terms and policies.
User-Generated Content
Your Right to Post Content & Community Spaces
Our Service may allow You to post Content, text, reflections, testimonials, or comments within designated community areas, discussion rooms, or class feeds. You are solely responsible for the Content that You post to the Service, including its legality, reliability, safety and appropriateness.
By posting Content to the Service, You grant Us a non-exclusive, royalty-free right and license to display, reproduce, host, and distribute such Content solely on and through the Service to facilitate your online group experience. You retain any and all of Your underlying rights to any Content You submit, post or display on or through the Service, and You are responsible for protecting those rights. You agree that this license includes the right for Us to make Your Content visible to other authorized members of that specific group or classroom, who may also interact with Your Content subject to these Terms of Service.
You represent and warrant that: (i) the Content is Yours (You own it) or You have the explicit legal right to use it and grant Us the rights and license as provided in these Terms, and (ii) the posting of Your Content on or through the Service does not violate the privacy rights, publicity rights, copyrights, contract rights or any other rights of any person.
Content Restrictions & Group Guidelines
The Company is not responsible for the content, opinions, or advice posted by the Service's users. You expressly understand and agree that You are solely responsible for the Content and for all activity that occurs under Your Account, whether executed by You or any third person using Your Account.
Because our platform hosts sensitive spaces for functional health, somatic integration, and breathwork, maintaining a safe and supportive container is paramount. You may not transmit or upload any Content that is unlawful, offensive, upsetting, threatening, libelous, defamatory, or otherwise objectionable. Examples of prohibited behavior and objectionable Content include, but are not limited to, the following:
- Breaching Confidentiality: Sharing, screenshotting, copying, or distributing private personal background details, emotional disclosures, or health stories shared by other members within our private discussion rooms or group classrooms.

- Impersonation: Impersonating any person or entity, including the Company, its employees, or representatives.
The Company reserves the right, but not the obligation, to, in its sole discretion, determine whether or not any user Content is appropriate and complies with these Terms of Service. We reserve the absolute right to refuse, edit, reformat, or permanently remove any user Content without prior warning. The Company further reserves the right to immediately limit, suspend, or revoke Your Account access entirely if You post objectionable Content or violate the emotional safety of our community containers.
Content Backups
Although regular system backups are performed on our hosting platform, the Company does not guarantee there will be no loss or corruption of data.
Corrupt or invalid backup points may be caused by, without limitation, technical glitches or data that changes during the time a backup is performed. The Company will provide reasonable support and attempt to troubleshoot any known issues that may affect your course vaults or portal materials. However, You acknowledge that the Company has no liability related to the temporary loss of data integrity or the failure to successfully restore user-generated forum text to a usable state. You agree to maintain an independent copy of any personal journaling or reflections you wish to safeguard permanently outside of the Service.

You may be held accountable for damages (including costs and attorneys' fees) for misrepresenting that any Content is infringing Your copyright.

You may submit a notification pursuant to the Digital Millennium Copyright Act (DMCA) by providing our Copyright Agent with the following information in writing (see 17 U.S.C 512(c)(3) for further detail):
- An electronic or physical signature of the person authorized to act on behalf of the owner of the copyright's interest.
- A description of the copyrighted work that You claim has been infringed, including the URL (i.e., web page address) of the location where the copyrighted work exists or a copy of the copyrighted work.
- Identification of the URL or other specific location on the Service where the material that You claim is infringing is located.
- Your address, telephone number, and email address.
- A statement by You that You have a good faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law.
- A statement by You, made under penalty of perjury, that the above information in Your notice is accurate and that You are the copyright owner or authorized to act on the copyright owner's behalf.
You can contact our Designated Copyright Agent via email at misha@misharank.com. Upon receipt of a notification, the Company will take whatever action, in its sole discretion, it deems appropriate, including the immediate removal of the challenged content from the Service and the suspension of the offending user Account.
Intellectual Property
The Service and its original content (excluding Content provided by You or other users), features, and functionality are and will remain the exclusive property of the Company and its licensors. Our original website content, recorded breathwork tracks, video modules, educational worksheets, and guide materials are protected by copyright, trademark, and other laws of both Hawaii, the United States, and foreign countries.
Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of the Company.
Your Feedback to Us
You assign all rights, title and interest in any Feedback You provide the Company. If for any reason such assignment is ineffective, You agree to grant the Company a non-exclusive, perpetual, irrevocable, royalty free, worldwide right and license to use, reproduce, disclose, sub-license, distribute, modify and exploit such Feedback without restriction or financial compensation to You.
Links to Other Websites
Our Service may contain links to third-party websites or services that are not owned or controlled by the Company.
The Company has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third-party websites or services. You further acknowledge and agree that the Company shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with the use of or reliance on any such content, goods or services available on or through any such websites or services.
We strongly advise You to read the terms of service and privacy policies of any third-party websites or services that You visit.
Links from a Third-Party Social Media Service
The Service may display, include, make available, or link to content or services provided by a Third-Party Social Media Service. A Third-Party Social Media Service is not owned or controlled by the Company, and the Company does not endorse or assume responsibility for any Third-Party Social Media Service.
You acknowledge and agree that the Company shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with Your access to or use of any Third-Party Social Media Service, including any content, goods, or services made available through them. Your use of any Third-Party Social Media Service is governed by that specific platform’s terms of service and privacy policies.
Termination
We may terminate or suspend Your Account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if You breach these Terms of Service, violate our community confidentiality rules, or disrupt the energetic safety of our group containers.
Upon termination, Your right to use the Service will cease immediately. If You wish to terminate Your Account, You may simply discontinue using the Service or cancel your automated renewal within your dashboard. All fees previously paid to Us are completely non-refundable upon account termination. In no event will any account suspension or termination relieve You of the obligation to pay any outstanding balances or installment plan fees payable to Us for the period prior to termination.
Limitation of Liability
Notwithstanding any damages that You might incur, the entire liability of the Company and any of its suppliers under any provision of these Terms of Service and Your exclusive remedy for all of the foregoing shall be limited to the amount actually paid by You through the Service or 100 USD if You haven't purchased anything through the Service.
To the maximum extent permitted by applicable law, in no event shall the Company or its suppliers be liable for any special, incidental, indirect, or consequential damages whatsoever (including, but not limited to, damages for loss of profits, loss of data or other information, for platform business interruption, for personal injury, illness, or physiological or emotional responses arising out of or in any way related to the use of or inability to use our somatic exercises, recorded breathwork tracks, or wellness Service, third-party software used with the Service, or otherwise in connection with any provision of these Terms of Service), even if the Company has been advised of the possibility of such damages and even if the remedy fails of its essential purpose.
Some states do not allow the exclusion of implied warranties or limitation of liability for incidental or consequential damages, which means that some of the above limitations may not apply. In these states, each party's liability will be limited to the greatest extent permitted by law.

You represent and warrant that (i) You are not located in a country that is subject to the United States government embargo, or that has been designated by the United States government as a "terrorist supporting" country, and (ii) You are not listed on any United States government list of prohibited or restricted parties.
Severability and Waiver
Severability
If any provision of these Terms of Service is held to be unenforceable or invalid, such provision will be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law and the remaining provisions will continue in full force and effect.
Waiver
Except as provided herein, the failure to exercise a right or to require performance of an obligation under these Terms of Service shall not affect a party's ability to exercise such right or require such performance at any time thereafter nor shall the waiver of a breach constitute a waiver of any subsequent breach.
